Privacy Policy

This DepartureCheck™ Privacy Policy applies to and governs the DepartureCheck™ (the “Program”) offered by NATA Compliance Services, LLC (“NATACS,” “we,” “us,” or “our”). Through the Program mobile application and web services (collectively, the “Program Application”), we offer features that allow you to report information related to COVID-19 testing results, whether you have recovered from COVID-19 and COVID-19 vaccination status, and to attest to the accuracy of the information that you report (the “Services”), as may be required by applicable law.  

The DepartureCheck™ Privacy Policy describes how NATACS collects, uses, shares, and safeguards your personal information in the context of the Program, both online and offline. This Privacy Policy also tells you about your rights and choices with respect to your personal information and how you can reach us to get answers to your questions. With regard to information we collect about you through the Program, this Privacy Policy supersedes and replaces any other privacy policies maintained by us. You can jump to particular topics of interest by going to the headings below:

Types Of Information We Collect. 

The following provides examples of the type of information that we collect from you: 

  • Account Registration. We collect your name and contact information when you create an account. We also collect information relating to the actions that you perform while logged into your account. 
  • Contact Information. We collect personal contact details such as name, addresses, telephone numbers, and email address. 
  • Biographical Information. We collect personal identifiers such as your birthdate 
  • Information regarding COVID-19 Test Results and/or Recovery StatusWe collect information that you provide to us relating to COVID-19, including your COVID-19 test results and/or whether you have had and recovered from COVID-19. 
  • Information regarding Vaccination StatusWe collect information that you provide to us relating to your COVID-19 vaccination status. 
  • Travel History. We collect information that you provide to us about when and where you have recently traveled. 
  • Attestation. We collect your attestation (a written statement a statement, writing, entry, or other representation under 18 U.S.C. § 1001) that confirms that information described above is true and accurate. 
  • Employment. If you are employed by one of our aviation clients, we may collect information about your employer and job title. 
  • Feedback/Support. If you provide us feedback or contact us for support we will collect your name and e-mail address, as well as any other content that you send to us, in order to reply. 
  • Mobile DevicesWe collect information from your mobile device such as unique identifying information broadcast from your device when visiting our website or when visiting one of our stores. 
  • Website Interactions. We use technology to monitor how you interact with our website. This may include the information that you type into our online forms.  This may also include information about your device or browser. 
  • Cookies and first party tracking. We use cookies and clear GIFs. “Cookies” are small pieces of information that a website sends to a computer’s hard drive while a web site is viewed. 

Use And Processing Of Information. 

We use this information in the following ways:  

  • To provide you with the Services.  
  • To comply with our obligations under applicable law.  
  • To identify you when you use the Program Application.  
  • To improve the Program.  
  • To respond to inquiries related to support or other requests.   
  • For internal administrative purposes, as well as to manage our relationships. 

Sharing Of Information. 

In addition to the specific situations discussed elsewhere in this policy, we disclose information in the following situations: 

  1. In Accordance with the Requirements of Federal and State Orders & Laws. We may share certain information collected through the Program with Federal or State agencies in order to comply with our obligations under applicable orders and laws. For example, we share information about your attestation to the accuracy of your reported COVID-19 test result and/or whether you have had and recovered from COVID-19 with the Center for Disease Control (“CDC”), as is required under an order issued by the CDC.  
  2. Affiliates and Acquisitions. We may share information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, or other companies under common control).  If another company acquires, or plans to acquire, our company, business, or our assets, we will also share information with that company.   
  3. Other Disclosures with Your Consent.  We may ask if you would like us to share your information with other unaffiliated third parties who are not described elsewhere in this policy. 
  4. Other Disclosures without Your Consent. We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws.  We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the shipment of products to or the provision of services by a third party intermediary. 
  5. Service Providers. We may share your information with service providers.  Among other things, service providers may help us to administer the Program Application or provide technical support. 

Please note that we do not currently recognize automated browser signals regarding tracking mechanisms, which may include "Do Not Track" instructions. 

How We Protect Personal Information 

We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to us in connection with the Program, and you do so at your own risk. In the event that we are required by law to inform you of any unauthorized access to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.  

You may be permitted to create an account when you use the Program Application in connection with the Program.  When you do you will be prompted to create a password.  You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you.  You should notify us of any unauthorized use of your password or account. 

Changes To This Privacy Policy.  We reserve the right to modify this DepartureChecktm Privacy Notice at any time, so please review it frequently. Access and/or use of the Program Application following any modifications to the DepartureChecktm Privacy Notice constitutes your agreement to follow and be bound by this DepartureChecktm Privacy Notice as changed.
